Welcome to Elimvia, an online learning platform operated from Kenya.
These Terms and Conditions (“Terms”) govern your access to and use of https://learning.elimvia.com and our related services (“Service”).
By accessing or using our platform, you agree to these Terms. If you do not agree, please do not use our Service.
Elimvia (“we”, “us”, “our”) provides an online learning environment where instructors can create and publish educational content and where students can enroll in, purchase, and access online courses.
We may offer both free and paid content through the web platform and our mobile applications.
You must be at least 18 years old or the age of legal majority in your country to create an account or make purchases.
If you are under 18, you may use the platform only with parental or guardian consent.
To access most features, you must create an account with accurate information.
You agree to:
Provide truthful, current, and complete details during registration.
Keep your login credentials confidential.
Be responsible for all activities under your account.
We may suspend or terminate your account if we believe you have violated these Terms or provided false information.
You agree to use Elimvia only for lawful purposes and in accordance with these Terms.

Attempt to hack, disrupt, or interfere with the Service.

Misuse any course materials or intellectual property.
We reserve the right to monitor platform activity and take appropriate action, including account suspension or removal of content.
When you enroll in a course, you receive a limited, non-exclusive, non-transferable license to view the course content for personal educational use only.
Unless specified, course access does not grant ownership or resale rights to any materials.
We may disable access to a course if required by law, by the content provider, or for policy violations.
Courses may be free or paid. Prices are displayed in Kenyan Shillings (KES) or other currencies as available.
All payments are processed securely through third-party payment gateways (e.g., Paystack, Flutterwave, Stripe, or M-Pesa).
By making a payment, you agree to:
Provide accurate billing information.
Authorize us and our payment partners to process the payment.
We are not responsible for transaction failures caused by network issues, incorrect payment details, or third-party gateway errors.
Refunds are generally not available once course content has been accessed or downloaded.
However, Elimvia may, at its discretion, grant a refund within 7 days of purchase if:
You cannot access the course due to a verified technical issue; or
The course content is materially different from its description.
To request a refund, email support@elimvia.com with proof of purchase and details of your issue.
If you are an instructor on Elimvia, you agree to:
Upload only original content that you have rights to share.
Ensure your courses comply with all applicable laws.
Avoid infringing on third-party copyrights or trademarks.
Provide accurate course information, pricing, and updates.
Elimvia reserves the right to remove any course that violates these conditions or legal requirements.
All content on Elimvia — including courses, videos, text, graphics, logos, and software — is protected by copyright and other intellectual property laws.
You may not reproduce, modify, distribute, or publicly display any content without written permission from Elimvia or the content owner.
If you believe your copyrighted material has been infringed, please contact legal@elimvia.com.
By posting reviews, comments, or feedback, you grant Elimvia a non-exclusive, worldwide, royalty-free license to use, display, and distribute that content in connection with our Service.
We may remove any content that violates our policies or applicable law.
Our platform may integrate with or link to third-party services (e.g., payment processors, live video providers).
Elimvia is not responsible for the content, privacy, or practices of third-party services.
Your use of such services is subject to their own terms and privacy policies.
Your privacy is important to us.
All personal information is handled in accordance with the Kenyan Data Protection Act, 2019 and our Privacy Policy available at https://learning.elimvia.com/privacy-policy.
To the fullest extent permitted by law:
Elimvia and its affiliates are not liable for any indirect, incidental, or consequential damages arising from your use of the platform.
We do not guarantee that all courses or content are error-free, uninterrupted, or always available.
You use the platform at your own risk.
Some jurisdictions may not allow these limitations, so they may not apply in all cases.
We may suspend or terminate your account or restrict access if:
You violate these Terms;
Your actions harm other users or the platform;
Required by law or court order.
You may terminate your account at any time by contacting support@elimvia.com.
Upon termination, your right to access the Service immediately ends, though certain legal and payment obligations may continue.
You agree to indemnify and hold harmless Elimvia, its officers, employees, and partners from any claims, losses, damages, or expenses (including legal fees) arising from your use of the platform or violation of these Terms.
We may update these Terms periodically.
The revised version will be posted on this page with a new “effective date.”
By continuing to use the platform after changes take effect, you accept the updated Terms.
These Terms are governed by the laws of Kenya.
Any disputes shall be subject to the jurisdiction of the Kenyan courts, unless otherwise required by applicable law.
